WASHINGTON — Frank S. Swain, a partner at Baker & Daniels LLP and a senior vice president at B&D Consulting, testified before the House Committee on Small Business during a hearing entitled, "Lifting the Weight of Regulations: Growing Jobs by Reducing Regulatory Burdens."
The hearing on June 15, 2011, examined H.R. 527, the Regulatory Flexibility Improvements Act of 2011, and H.R. 585, the Small Business Size Standard Flexibility Act of 2011. The two bills are designed to remove loopholes in the Regulatory Flexibility Act (RFA), as amended by the Small Business Regulatory Enforcement Fairness Act (SBREFA), and strengthen the power of the Office of the Chief Counsel for Advocacy.
In his testimony, Swain called for strengthening administrative procedures which protect small business from unnecessary federal regulation.
Other testimony before the committee, which is chaired by Rep. Sam Graves (R-MO), came from:
- Jane C. Luxton of Pepper Hamilton in Washington, D.C.;
- Harry J. Katrichis of The Advocacy Group in Washington, D.C.; and
- Dr. Adam Finkel, Fellow and Executive Director of the Penn Program on Regulation at the University of Pennsylvania Law School in Philadelphia.
Before joining Baker & Daniels and B&D Consulting in 1990, Swain served as the Chief Counsel for Advocacy at the United States Small Business Administration. He also served as legislative counsel to the National Federation of Independent Business.
