On September 14, 2012, the White House Office of Management and Budget released a report detailing how so-called "sequestration" will impact specific federal programs and agency funding in FY 2013. In examining the budgetary resources available to the U.S. Food and Drug Administration, OMB determined that all resources, including industry-paid fees, are subject to sequestration. This led to significant confusion among biomedical product manufacturers as they grapple with the "real life" impact of this determination. In the article "September Sequester Surprise: FDA User Fees on the Chopping Block" in BNA's Pharmaceutical Law & Industry Report, Phil Bonforte of FaegreBD Consulting explained what sequestration is and analyzed how the sequestration of FDA industry-paid fees will affect FDA-regulated industries and FDA funding in FY 2013.
